Under the federal Fair Labor Standards Act (FLSA), non-exempt employees must be paid 1.5× their regular rate for hours over 40 in a workweek. Some states (California, Alaska, Nevada) require daily overtime over 8 hours.

What is double-time pay?

Double-time (2× the regular rate) is required only in California: for hours over 12 in a workday, or hours over 8 on the 7th consecutive day of work in a workweek.

Who is exempt from overtime?

Salaried executive, administrative, professional, computer, and outside sales employees can be exempt if they meet salary thresholds and duties tests. As of 2026, the salary threshold is $58,656/year ($1,128/week). Below this, overtime applies regardless of job title.

Does overtime apply to salaried employees?

Yes, if the employee is "non-exempt." Many salaried employees under the $58,656 threshold (2026) are eligible for overtime. Title alone does not exempt someone — duties and salary tests apply.

How does overtime work for tipped employees?

Overtime is calculated on the full minimum wage, not the lower tipped cash wage. Example: tipped employee at $5/hr cash + tips → overtime rate is 1.5× the full state minimum wage, not 1.5× $5.
