How does overtime work in the US?
Under the federal Fair Labor Standards Act (FLSA), hours over 40 in a workweek must be paid at 1.5× the regular rate for non-exempt employees. Some states (California, for example) also require daily overtime over 8 hours.
Do I need to subtract lunch breaks?
Yes. Under US labor law, unpaid meal breaks of 30 minutes or more must be subtracted from total hours worked. Paid short breaks (under 20 minutes) are typically included in hours worked.
